Please read these Terms carefully before you start to use our website.
In these Terms, “we”, “us” and “our” means Salary Finance Limited and “you” and “your” means the website user.
1 About Salary Finance
1.1 Salary Finance Limited is incorporated and registered in England and Wales with company number 09677777. Our registered
address is One Hammersmith Broadway, London W6 9DL.
1.2 We are a consumer credit business, authorised and regulated by the Financial Conduct Authority. Our firm reference number
2 Registration process
2.1 To apply for a loan through us, you must register on our website and your employer must be registered with Salary Finance
2.2 As part of the registration process, you agree:
2.2.1 to your employer sharing relevant information with us to enable us to validate loan application details and to manage
repayments from salary deductions. Data items include:
- Payroll ID;
- Gross basic annual salary;
- Start date;
- Date of birth;
- Status (e.g. Active, Leaver, etc.); and
- Previous period’s net pay;
2.2.2 that following a successful loan application and related advance of funds, we will tell your employer the amount you
need to repay each month so that they can make the payments on your behalf from your salary and transfer any such deducted
sum to us (or to any other lender) under your loan agreement.
2.3 Any information you provide to us must be up to date and accurate.
2.4 If false or inaccurate information is provided and fraud is identified, details will be passed to fraud prevention agencies.
2.5 Law enforcement agencies may access and use this information.
2.6 We and other organisations may also access and use this information to prevent fraud and money laundering, for example, when:
2.6.1 checking details on applications for credit and credit-related or other facilities;
2.6.2 managing credit and credit-related accounts or facilities;
2.6.3 recovering debt;
2.6.4 checking details on proposals and claims for all types of insurance; and / or
2.6.5 checking details of job applicants and employees.
2.7 Please contact us at firstname.lastname@example.org if you want to receive details of the relevant fraud prevention agencies.
2.8 We and other organisations may access and use from other countries the information recorded by fraud prevention agencies.
2.9 We may provide third parties with non-personal statistical data, for example relating to the size of our customer base and
the levels of site usage. This will only be group data, such as the age range of site users, and will not include any
information that could personally identify you.
3 Submitting a loan application
3.1 Please note any loan decision given during the application process via our website will be for indicative purposes only and we will need to carry out credit checks before any formal loan commitments are confirmed.
3.2 We will only share your information with the following third parties:
3.2.1. One or more credit reference agencies (”
CRAs“) who may use the information to access and share information about your credit history;
3.2.2. GoCardless who may use the information to set up a Direct Debit instruction; and
3.2.3. Adobe who may use the information to enable you to electronically sign a loan agreement and Direct Debit mandate
on their web platform.
3.3 Upon submitting a loan application, we will carry out a credit search on you. The search at this stage will be an enquiry
search and will not affect your credit rating.
3.4 We may search the Electoral Roll and other information held about your present and previous addresses as part of this credit search.
3.5 Your information will be shared with CRAs, which may keep a record of such information. This will not affect your credit
3.6 If we do not approve your loan application, we may at our absolute discretion choose to offer you an alternative proposal
for credit for a smaller amount and over a shorter period compared with your original loan application (“Salary Finance
Starter Loan”). We will choose the amount, interest rate and term applicable to your Salary Finance Starter Loan based
on the information provided in your application and by our CRA. The Salary Finance Starter Loan will remain available
for at least 14-days after which it will lapse and you will need to submit a new loan application if you wish to apply
for a Salary Finance Loan.
3.7 If you are successful in your application for a loan, and you decide to proceed with the loan, we will carry out an application
search. Loans are subject to status.
3.8 We do not offer advice. If you are not sure about what is best for your own financial situation you might want to seek independent
4 Using information about you – application search and on-going information sharing
4.1 You understand that we get information about you in different ways, for example:
4.1.1 information you give us or other companies in our group when you apply for a loan or at other times;
4.1.2 what we or other companies in our group learn from our relationship with you;
4.1.3 public records like the Electoral Register, County Court Judgments and bankruptcies; and / or
4.1.4 outside sources such as banks, your online banking information (accessed by a third-party data service), CRAs
and customer service providers to help us with customer verification and credit-related decisions.
4.2 You agree that we can use this information for a range of purposes including:
4.2.1 searching CRAs’ records;
4.2.2 to make, or assist in making, lending decisions about you and to check the details that you have let us and others
4.2.3 to operate and manage your account and manage any application, agreement or correspondence you may have with us;
4.2.4 to contact you by email, SMS, letter, telephone or in any other way about our products and services, unless you
tell us that you prefer not to receive marketing (see below);
4.2.5 to identify, prevent, detect or tackle fraud, money laundering, terrorism and other crimes; and / or
4.2.6 to form a view of you as an individual and to identify, develop or improve products, that may be of interest
to you and to carry out market research, business and statistical analysis.
4.3 You agree we may give information about you to others including:
4.3.1 our group companies;
4.3.2 with any firm, organisation or person we use to help us operate our lending business, to collect payments and
recover debts or to provide a service on our behalf;
4.3.3 with CRAs or any similar organisation which provides a centralised application matching service that collects
information from and about mortgage and/or credit applications, for the purpose of preventing and detecting fraud;
4.3.4 with any person to whom we sell or transfer (or enter into negotiations to sell or transfer) our business or
any of our rights or obligations under any agreement we may have with you. If the transfer or sale goes ahead, the
transferee or purchaser may use your personal information in the same way as us; and / or
4.3.5 with regulatory and governmental authorities, ombudsmen, or other authorities, including tax authorities, including
those overseas, where we are requested by them to do so.
4.4 It is important that you understand and agree to how we use CRAs and how they use information we give them.
4.5 We may check your details with CRAs, both when you apply to us for a loan and from time to time as we manage your account.
The CRAs will record our searches.
4.6 We may tell CRAs how you run your relationship with us, including whether or not you make your loan repayments on time, if
you default on your loan or enter into any repayment arrangements. This reporting may make obtaining future credit more
4.7 We and others may also access and use CRA records about you on similar occasions, both for similar purposes and to check
your credit history.
4.8 We and other organisations may access and use the information recorded by CRAs from other countries.
4.9 CRAs may link you (or may already have linked you) with others who are financially ”
associated” with you. They may include, for example:
4.9.1 anyone applying jointly with you now or in the past;
4.9.2 your husband, wife or partner (and maybe, as appropriate, other members of your family and household); and /
4.9.3 your business, if you are a director or partner in a small business.
4.10 You will stay linked to a financial associate until you (or your financial associate) successfully apply to the record keepers
disassociation“. Whenever we get, use or give others information about you, we may do the same (for related
purposes) with information about your financial associate.
5 Closing your account
5.1 Once your loan has been repaid in full, you may cancel your Salary Finance registration by notifying us via email. You will
no longer be able to access your secure area of our website.
5.2 Following cancellation, we will continue to maintain records to the extent we are required by law to do so.
5.3 We reserve the right to deny access to the site if we feel there is a legitimate reason to do so, including but not limited
5.3.1 any serious or repeated breach of these Terms;
5.3.2 any suspected criminal activity; and / or
5.3.3 any suspected misuse of or damage to the service.
5.4 If your access to the secure of our website is terminated, that does not affect your obligation to repay any outstanding
5.5 We reserve the right to suspend your account if it has been inactive for twelve months or more.
6.1 You are responsible for safeguarding your login details. You should not share them with anyone.
6.2 You must contact us immediately if you believe that your account has been compromised or if you believe that the security
of your account is at risk.
7.1 Any notices from us to you about your use of our website and the services we provide to you (for example, important statements
and communications about your loan) shall either be displayed in your online account or emailed to you at the latest
email address which you have provided to us.
7.2 It is your responsibility to provide us with a valid email address and to notify us if your details change.
8 Purchasing products and services from third parties
8.1 For your convenience, the site may contain links to third party websites. Third party websites are not controlled by us and
therefore we cannot be held responsible for their content or actions.
9 Our liability
9.1 We will do our best to ensure that our service runs smoothly. However, we do not warrant that your use of this website will
always be uninterrupted or error free.
9.2 We shall bear no liability for any computer or internet failures that you experience while using the website.
9.3 While we take all reasonable precautions to keep the website and its server free from viruses and corrupt files, we cannot
guarantee this. You should ensure that you have appropriate anti-virus software installed on any computer or mobile
devices that you use to access the website.
9.4 We shall not be liable for any loss or damage you suffer if your computer or mobile device is infected by a virus or corrupt
file unless such loss or damage is the direct result of our negligence or deliberate default.
9.5 Nothing in these Terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud
or fraudulent misrepresentation and any other liability that cannot be limited or excluded by English law.
10 Data protection and privacy
10.1 We are registered under the Data Protection Act and we take our responsibility for data security and privacy seriously.
10.2 For the purpose of the Data Protection Act 1998 (the “Act”), the data controller is Salary Finance Limited of One Hammersmith
Broadway, London, W6 9DL. Our data controller ICO registration reference number is ZA152606.
11 Sanctions and termination
11.1 We may suspend, restrict or block your access to the website if we reasonably think it is necessary because, for example:
11.1.1 the security of your account is at risk (for example, if you have not updated your internet browser to the latest
11.1.2 we suspect unauthorised or fraudulent use of your account;
11.1.3 to comply with any legal or regulatory requirement;
11.1.4 you have knowingly given us false information about yourself; and / or
11.1.5 for any reason beyond our reasonable control.
11.2 Where possible we will contact you before suspending, restricting or blocking your access to tell you that we are doing so
and why. We may do this by displaying a message the next time you try to log on or perform an action on your account.
However, we may not always be able to contact you, for example because of legal or regulatory restrictions.
